Corporate Manslaughter

Health and safety: first corporate manslaughter prosecution

The first case brought against a business under the new corporate manslaughter legislation has been further delayed. The case was brought following the death of an employee who was killed while taking soil samples from a building site. It is seen as a test case for the legislation in terms of the factors the court will take into account when deciding whether a business' activities were managed in such a manner as to cause a person's death.

With criminal prosecutions for safety-related offences on the increase, businesses need to be aware of the impact that a conviction can have on its operations. This checklist sets out the potential implications.
