Trust and probate litigation

We work closely with our Dispute Resoution Team, to offer advice in relation to disputes regarding wills, trusts, estates and inheritance.
We can advise on the validity of wills and can investigate if a will was executed accurately, made with the required mental capacity and with an understanding of its contents and without undue influence.

We can review the administration of an estate and advise executors, personal representatives and beneficiaries of their position. If an executor or trustee is in breach of their duty to deal with an estate within a reasonable time, we can make an application, on an entitled person's behalf, to the court for an order against the executor/trustee, or for their removal.

We can establish if there has been any professional negligence against a will draftsman, or professional executor or trustee.

We can advise in matters involving the Court of Protection, concerning the appointment of attorneys and their actions when appointed.

If you feel you have not received sufficient financial provision from a parent or loved one, to whom you had a financial dependence on during their lifetime, you may make a claim under the Inheritance (Provision for Family and Dependants) Act 1975, where a court has the power to make an award in your favour.
